This website is a service offered to our customers. By using our site, you agree to comply with and be bound by the following terms and conditions of use. Please review the following terms and conditions carefully. If you do not accept these terms and conditions, you may not obtain goods or products from this site.

Price Difference

Prices displayed on the website apply to online purchases only and may differ from in-store prices.

Acceptance of the Agreement

You agree to the terms and conditions set out in these Terms and Conditions of Use with respect to our site (the "Site"). This Agreement constitutes the entire and only agreement between us and you. It supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, its content, the products or services offered by or through the Site, and the subject matter of this Agreement. We may amend this Agreement at any time without specific notice. The most recent version will be posted on the Site, and you should review it before using the Site.

Copyright

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyright, trademark and other proprietary rights (including, but not limited to, intellectual property). You are strictly prohibited from copying, redistributing, using or publishing any such matters or any part of the Site, except as permitted under the "Limited Right of Use" section. You do not acquire any ownership rights to any content, document or other material displayed on the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

Fraud

By becoming a member, you confirm that the information provided in the form is accurate and you agree to comply with the Site's Terms and Conditions of Use. Please note that your membership may be cancelled without notice if it is determined that the information provided is false or misleading, that the Terms and Conditions of Use have been violated, or that other abuse has occurred. Passion Diecast may revoke membership at its sole discretion. Passion Diecast reserves the right to refuse any application for membership or readmission to the membership program.

Limited Right of Use

The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, non-exclusive licence, for your own personal use only. This licence excludes republication, distribution, assignment, sublicensing, sale, preparation of derivative works and any other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (and not for resale or redistribution).

Disclaimer

Information from or through the Site is provided "as is" and "as available." All warranties, express or implied, are expressly disclaimed (including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose). The information and services may contain bugs, errors, problems or other limitations. We and our related parties assume no liability for your use of any information or service.

In particular, but without limitation, we and our related parties are not liable for any indirect, special, incidental or consequential damages (including loss of business, loss of profits, litigation or otherwise) arising from breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. Limitations

We disclaim all liability for any damage caused by viruses contained in the electronic files of the form or document. We will not be liable to you for any indirect, special or consequential damages of any kind that may result from the use of, or inability to use, our Site. Our maximum liability to you under any circumstances will be equal to the purchase price you paid for the goods, services or information.

Privacy Policy

Our privacy policy, which may change from time to time, forms part of this Agreement.

Payments

If you purchase anything from us or our merchants, you represent and warrant that the credit card information you provide is true, accurate and complete, that the charges you incur will be honoured by your credit card company, and that you will pay the charges incurred at the posted prices, including shipping charges and applicable taxes.

Return Policy

Due to the nature of our online site and the products offered, Passion Diecast has a strict no-return policy. No product may be returned unless the product is defective and the defect or breakage was caused neither by the shipping companies nor by improper handling or use on your part. The item may then be exchanged for the same item or a similar one. We do not issue refunds. Any claim must be made no later than three days after receipt of the product. Return shipping costs are the customer's responsibility.

Minor Manufacturing Defects

Some models may have slight imperfections due to their manufacturing process that affect neither their functionality nor their use. These may include:

  • small imperfections in the finish;
  • accessories that may differ from those illustrated;
  • colour variations;
  • alignment of decorative stripes;
  • small spots or gaps in the paint;
  • minor defects on the packaging.

It is rare to find a model completely free of defects, especially among entry-level and mid-range models. These details are therefore considered normal, are part of the manufacturing process and are not covered by our return policy. By confirming your order, you accept these conditions.

Cancelled Orders

For any order cancelled after processing, particularly orders containing in-stock products or pre-order products, a 10% cancellation fee will be withheld, along with credit card or PayPal transaction fees, which are non-refundable.

Refunds

Please note that the credit card transaction fees charged to us are non-refundable unless you choose store credit.

Pre-Orders

Pre-orders are firm and non-refundable. However, if you still wish to cancel your pre-order, we may, on an exceptional basis, issue a refund using the payment method used at the time of purchase. A 10% cancellation fee will then be withheld, along with credit card or PayPal transaction fees, which are non-refundable.

Invoice Changes

A $5 service fee applies to any change to an invoice that has already been processed or is being prepared.

Shipping Fees

Under no circumstances do we refund shipping fees if you refuse the package or if it is returned to us. Return shipping costs are then your responsibility.

Product Condition

All our products are new unless otherwise stated.

Our policy is to ensure that you receive a product in perfect condition with no missing parts. For this reason, we inspect and photograph all our products before shipping, which also helps prevent certain abuses by malicious customers.

If you prefer to receive a sealed, unopened product, please let us know at the time of purchase. In that case, you assume responsibility if a part is missing or if the product has a defect, and we will ship it according to your request.

Shipping and Carriers

Passion Diecast offers you a choice of carriers. We are in no way responsible for any delays, mishandling or loss of packages. We recommend selecting the Expedited Parcel or Xpresspost options, which automatically include coverage of up to $100. See all regulations on the Canada Post website.

Due to the large number of package thefts and the excessive number of claims, any order over $100, or to an address we consider unsafe, is shipped with the "Card for pickup" option. This measure will remain in effect until Canada Post stops leaving packages in unsafe locations.
